Terms and Conditions

1. The Seller

JEANNE ET MARGUERITE was created by Anaïs BARAT whose head office is located in TARBES (65000). All orders placed on this site are subject to these general terms and conditions of sale and imply their prior, express and unreserved acceptance. JEANNE ET MARGUERITE reserves the right to adapt or modify these conditions at any time, the version of the T&Cs applicable to any transaction being the one appearing online on the site at the time of the order.

2. The Client

The customer declares to be a natural person, aged at least 18 years and to have the legal capacity or to hold parental authorization allowing him to place an order on the Site. As such, JEANNE ET MARGUERITE reserves the right, at any time, to ask the customer for proof of identity attesting to his age and/or the authorization of his legal representative.

When registering the customer's personal data in the "my account" section, the customer must ensure the accuracy and completeness of the mandatory data they provide. In the event of an error in the recipient's contact details, Anaïs BARAT cannot be held responsible for the impossibility of delivering the product. JEANNE ET MARGUERITE reserves the right to cancel any order when the customer's IP address is located in a country different from the billing and/or delivery address.

The Articles

The items offered for sale are those described on the website. JEANNE ET MARGUERITE takes the greatest care in the presentation and description of these products to best satisfy the customer's information needs. However, it is possible that non-substantial errors may appear on the website (particularly in the description or with regard to the quality of the product photos), which the customer acknowledges and accepts.

In any event, in the event of non-conformity of the delivered product with respect to its description on the site, the customer may either exercise his right of withdrawal described in article VI below), or implement the guarantee of conformity of JEANNE ET MARGUERITE which will proceed, where appropriate, to the exchange, to the reimbursement of the price (in whole or in part) possibly invoiced, or to the issue of a credit note corresponding to the price of the product(s) concerned by the exercise of the right of withdrawal which will be valid on a future order made within one year from its issue.

The price

The sales prices, in accordance with article L. 112-1 of the Consumer Code (formerly C. conso., art. L. 113-13), are indicated, for each of the products appearing in the electronic catalogue, in euros including all taxes, excluding delivery and transport costs mentioned before validation of the order and invoiced in addition.

The total amount due by the consumer is indicated on the order confirmation page.

The sale price of the product is that in effect on the day of the order.

The sale price of the products does not include shipping costs charged in addition to the price.

In the event of a promotion, the professional seller undertakes to apply the promotional price to any order placed during the period of advertising for the promotion.

The professional seller reserves the right to modify its prices at any time and without notice, in particular for reasons of inflation, taxation and legislation, while guaranteeing the consumer the application of the price in force on the day of the order.

Additional transport, delivery or postage costs (to which must be added any other costs incurred by the seller), which the customer may have been aware of before ordering, are set out on the order form.

The Order

Orders placed on the site are subject to compliance with the following procedure implemented by JEANNE ET MARGUERITE

a) Order on the site by the customer

To validate his order, the customer must follow the following steps:

1) product identification and selection

The customer must select one or more products offered on the site, which will be added to the shopping cart. By validating their shopping cart, the customer initiates the ordering process.

The customer must then log in to the website or create an account, specifying their title, first name, last name, billing address, and email address. The customer agrees to provide accurate information about their identity.

The customer is then informed of the accepted payment methods and any delivery restrictions (see below).

2) selection of delivery method

The customer must confirm the delivery method offered to him, namely:

Standard Delivery

When choosing the delivery method, the customer is informed of the amount of the delivery costs, as well as the delivery terms.

The customer must indicate the address to which they wish to be delivered if it is different from the address provided in the previous step. As well as their telephone number so that they can be contacted by the company in charge of delivery.

3) the order summary

A summary of the order will be displayed specifying the essential characteristics of the products, the quantity and price of the products, the delivery costs and the total amount of the order (delivery costs included).

The customer must read these T&Cs which will be available via a hyperlink and check the box “I accept the T&Cs”.

In accordance with the terms of Article L. 221-14 of the Consumer Code, the customer must click on the button “Proceed to payment of the order for validation” which constitutes validation of the order and the General Terms and Conditions (“first click”).

4) payment of the order

The customer will have the opportunity, before definitively confirming his order, to check the details of it and its total price, and to correct any errors, before confirming it to express his acceptance. Any order confirmed by the customer constitutes a sales contract and unreserved acceptance of all the provisions herein.

The customer then selects their payment method.

By credit card: the customer is automatically transferred to the Stripe payment server, in its capacity as JEANNE ET MARGUERITE's payment service provider, which is secured by Stripe. The customer must enter their credit card number, its expiry date, the name of the cardholder and the visual cryptogram corresponding to the last numbers written on the back of their credit card.

By making this payment, the customer guarantees that he is fully authorized to use the payment card for the payment of his order and that this card provides access to sufficient funds to cover all costs resulting from this order.

By providing credit card details, the customer accepts that JEANNE ET MARGUERITE will proceed with the secure transaction.

In the event that the debit of the amounts owed by the customer proves impossible (opposition, bank refusal, etc.), the order will not be registered by JEANNE ET MARGUERITE. The information relating to the Customer's bank card and communicated by the latter on the Site constitutes authorization for JEANNE ET MARGUERITE to debit his account for the full amount of his order.

5) Stock availability

Products are offered and delivered within the limits of available stocks.

In the event of unavailability of the product ordered, the seller shall immediately inform the buyer and may offer them a product of equivalent quality and price or, failing that, a voucher for the amount of the order which can be used for any future order.

In the event of disagreement by the buyer, the seller will reimburse the sums paid within one month from the date of purchase of the product.

b) Confirmation of the order by JEANNE ET MARGUERITE:

A confirmation email summarizing the order (products, price, product availability, quantity, delivery method chosen by the customer, etc.) will be sent to the customer by JEANNE ET MARGUERITE.

To this end, the customer formally accepts the use of email for confirmation by JEANNE ET MARGUERITE of the contents of his order. This email, which serves as an acknowledgment of receipt of the order, details all the essential conditions of the order, namely:

– the order reference

– the identity and contact details of the customer the nature, quantity and price of the products

– a reminder of delivery times, costs, terms and conditions and any delivery restrictions

– the total amount of the order (including delivery costs)

– information relating to the customer’s identity and contact details

– the withdrawal form

– where applicable, the fact that the customer bears the costs of returning the product in the event of withdrawal

the invoice, proof of confirmation of payment

the mention that an email specifying the package number linked to the order will be sent to the customer at the time of dispatch of the order.

6) Shipping the order

Orders are processed within a maximum of 72 hours from order confirmation.

Please note that the order is only sent to the customer after confirmation of the validity of the payment made by the customer.

Once the order has been validated and confirmed, it is sent to the delivery address provided by the customer during the ordering process.

The shipment is the subject of an email addressed to the customer in which JEANNE ET MARGUERITE specifies:

the nature, quantity and price of the products

the total amount of the order

billing and delivery details

Delivery

Delivery is made to the delivery address indicated by the customer, it being specified that delivery cannot be made to PO boxes.

In order to meet these deadlines, the customer must ensure that they have provided accurate and complete information regarding the delivery address (such as, in particular: street number, building number, staircase number, access codes, names and/or intercom numbers, or any other necessary information that will enable the order to be delivered).

The delivery times indicated are indicative, corresponding to the average processing and delivery times observed by the partner carriers that JEANNE ET MARGUERITE uses for the delivery of its products. In fact, with the Covid-19 health crisis, delivery times may be longer.

JEANNE ET MARGUERITE is held responsible for the consequences due to a delay in delivery not due to its fault.

In the event of damaged packages (already opened, missing products, etc.), the customer agrees to notify the carrier and JEANNE ET MARGUERITE, by any means, of any reservations within 3 days of receiving the product. In this case, the customer and JEANNE ET MARGUERITE will jointly consider the follow-up to this incident.

It is recalled that under Article L. 216-4 of the Consumer Code, any risk of loss or damage to the products is transferred to the customer at the time when the latter or a third party designated by him, and other than the carrier proposed by the professional, takes physical possession of these products.

THE RIGHT OF WITHDRAWAL AND RETURN PROCEDURES

Buyers, non-professional individuals, benefit from a withdrawal period of fourteen (14) days from receipt of their order to return the product to the seller for reimbursement without penalty, with the exception of the initial shipping costs (note that return costs are the responsibility of the buyer).

Products purchased during a promotion are neither exchangeable nor refundable.

To simplify the exercise of the right of withdrawal, JEANNE ET MARGUERITE asks customers to notify it by any means. The customer will also have the option of contacting customer service by email: jeanneetmarguerite@hotmail.com for any additional information. On this occasion, the customer must notify by email the return of one or more items. The Products must not have been worn, worn, altered, washed, or damaged. Indeed, for reasons of hygiene and health protection, earrings are not subject to possible return.

The Products must therefore be returned in perfect condition, complete in their original packaging intact, accompanied by the invoice to the following address:

JEANNE ET MARGUERITE reserves the right to refuse reimbursement of the returned Product in the event that the previously mentioned conditions are not respected.

Any customs charges related to the return of the product from a foreign country are also the responsibility of the Customer.

JEANNE ET MARGUERITE strongly advises its customers to return products by registered letter or Colissimo. The Customer also has the option of choosing the carrier of their choice. However, the return costs and associated risks are the responsibility of the Customer. It is therefore recommended that the Customer provide proof of this return, which requires that the products be returned with parcel tracking, or by any other means providing a specific date.

Returned Products must be sent to JEANNE ET MARGUERITE in a single shipment. JEANNE ET MARGUERITE reserves the right not to accept items from the same order that are returned and shipped at different times.

8. Reimbursement

If the right of withdrawal is exercised in accordance with the terms and conditions indicated above, JEANNE ET MARGUERITE will take the necessary steps to reimburse any sums already collected for the purchase of the products within fourteen (14) days after receipt and verification of the condition of the products.

In the event that there is no correspondence between the recipient of the products indicated in the order form and the person who made the payment of the amounts due for the purchase, the refund of the amount will be made to the person who made the payment.

Reimbursement will be made primarily by re-crediting the bank card debited during the purchase on the e-shop.

9. WARRANTY

For any complaints about your order, please contact customer service by email at jeanneetmarguerite@hotmail.com within a maximum of 72 hours of receiving your package.

The warranty is no longer valid after 30 days from the date of receipt.

All products supplied by the seller benefit from the legal guarantee provided for by articles 1641 et seq. of the Civil Code.

Under these guarantees, it may be returned to JEANNE ET MARGEURITE who will offer the Customer either a refund or an exchange for defective products or those that do not correspond to their order.

All claims or refunds must be made by email to the following address: jeanneetmarguerite@hotmail.com

In order to ensure rapid and quality processing of the warranty request, the Customer will specify their contact details, their order number and the reference of the item concerned and will detail as much as possible the problem encountered and, where possible, will attach a photograph of the product defect to the email.

Any claims for an order will be impossible after 30 days from the invoice date.

Applicable law and attribution of jurisdiction

Any order automatically implies the customer's acceptance of these General Terms and Conditions. These General Terms and Conditions are governed by French law. In the event of a dispute, the French courts will have sole jurisdiction. In the event of difficulty or complaint regarding an order, the customer can contact Customer Service to find an amicable solution, at the email address indicated on the site (jeanneetmarguerite@hotmail.com).

11. RESPONSIBILITY

The seller, in the online sales process, is only bound by an obligation of means; his liability cannot be incurred for damage resulting from the use of the Internet network such as loss of data, intrusion, virus, interruption of service, or other involuntary problems.

Information technology and freedoms

The information collected by v during a customer order is necessary for the management of the transaction and for this purpose may be communicated in whole or in part to JEANNE ET MARGUERITE's service providers involved in the execution of the order. The customer is informed that this same personal data may also be collected by an organization responsible for analyzing orders and combating credit card fraud. In accordance with the Data Protection Act No. 78-17 of January 6, 1978, the customer has the right to access, rectify, oppose and delete data concerning him.
